- Definitions
In these terms and conditions the following terms shall have the following meanings:-

‘You, Your’ – The Customer/Consumer
‘Contract’ – Means any order of goods by the Customer that is
accepted by Us.
‘Goods’ – Any Goods forming the subject of a Contract including parts of, or materials incorporated in, them as more particularly described upon this Website.

We take your privacy seriously. We are registered under and comply with the Data Protection Act 1998. For further details please see our Privacy Policy. - Product Pricing and Title
3.1 We make every effort to ensure that the pricing displayed on our website and within our quotations is correct. However, if an error in the pricing of a product is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable). The processing of an order can be cancelled or corrected by us at any time up to the shipment of that order and any related items.
3.2 We reserve the right to alter all product pricing without notice.
3.3 Title in any products ordered from us does not pass to you, the purchaser, until we have received and processed a valid payment, and that payment has been made into our own bank account and your order has been shipped. - Product Descriptions
We do our best to display everything exactly as you receive it. However, images shown on this website may vary in colour or finish from what is received, colour variations occur. - Your Order
5.1 When you place an order you will automatically receive a confirmation email from us to confirm your order.
Your order constitutes an offer made to us to purchase the goods specified in the order.
5.2 Your offer is only accepted by us once we have emailed you to confirm the dispatch of your order.
5.3 Product items not included within the dispatch email are not included in the order and contract between you and us.
5.4 We reserve the right to delay or refuse orders where a transaction contains incomplete details or details that cannot be verified or where fraud is suspected.
5.5 If we are unable to reasonably ascertain these details or resolve these issues a full refund will be made against the card used at the time of purchase. No other form of refund or credit will be offered nor will a refund be made to any third-party card or account. - Shipping
6.1 PLEASE DO NOT ARRANGE FOR INSTALLATION OF YOUR GOODS UNTIL THEY HAVE BEEN DELIVERED & CHECKED FOR DAMAGE.
We will not compensate you for missed appointments due to delays or damages. It is your responsibility to order items in good time and ensure they are undamaged and free from visual defect prior to engaging with an installer.
6.2 All orders received by us are shipped subject to availability.
6.3 We reserve the right to ship products at a later date (up to 30 days after purchase) where the product ordered is not in stock at the time of purchase. In this situation you will be contacted and offered a full refund instead of delivery of the product.
6.3 We cannot be held responsible for disruption to shipping caused by industrial disputes or action outside our direct control. If such disruption occurs, you will be offered a full refund. ·
6.4 Goods can only be delivered to the customer’s address (they cannot be left with a neighbour) and must be checked and signed for. Please note that the driver may require help unloading. The Carrier may also ask to see identification before leaving the goods, (to protect us from Credit Card fraud).
6.5 Delivery is to the doorstep only. - Cancellation Rights, Returns and Refunds
7.1·In accordance with the Consumer Rights Act, if you are not satisfied with the order or you have changed your mind, you have 30 days to inform us after receipt of the goods have been received, you are liable for the cost of the return. The cost of the original standard postage will be refunded, but not any upgraded services opted for such as Next Day. You will need to fill in a Returns form which can be downloaded here RETURNS FORM(click the link and then choose File and Save As), or e-mailed to you from our Customer Service dept. Once you have completed the form, please send to sales@hungerfordbathrooms.co.uk
They should be well packed and adequate insurance taken with your chosen courier, and they need to be returned direct to our supplier, whose details will also be emailed to you by our Customer Service dept. The items must be returned unused and in a resalable condition, including the original packaging. Reasonable deductions can be made to the refund if the item arrives back in a condition such that we cannot sell it as new or the packaging is missing or damaged. Your goods should be checked for damage or shortage within 5 days of delivery, after this time we may not able to provide a refund for these items. Once the item has been fitted or installed or attempted to be fitted or installed it is deemed that you have accepted those goods and we will not be able to replace goods as “damaged in transit” or “faulty” unless the fault is such that it could not have been seen before installation.
7.2 As stated above notification of cancellation must be in writing, a telephone call is not a valid cancellation. We will respond to your request by email and confirm that your order has been cancelled or has already been despatched. If you do not receive an email from us, then your order has not been cancelled. Orders that are cancelled after despatch by us are subject to any return collection charges incurred
7.3 No right of cancellation, refund or return exists under the Consumer Rights Act once you have used your product, unless the product is defective, and you are returning it for this reason.
7.4 Goods that are sealed or shrink-wrapped and this is removed should be properly repackaged before returning.
7.5 No right of cancellation exists for goods where there may be hygiene issues, unless defective.
7.6 Please observe the following procedure for all returns to us:
7.6.1 On the back of your delivery note or on another piece of paper, (if you no longer have your delivery note), include your order number and the reason for the return.
7.6.2 If you are returning your product because it is defective, please state the defect or defects.
7.6.3 Repackage the product in its original packaging, including any accessories, brochures, manuals, guarantees or warranties that came with the product. Unfortunately, we will be unable to issue a refund where the product is in an incomplete state.
7.7 You are responsible for paying any postage or shipping costs incurred when returning a product. See 7.14.
7.8 We recommend that all returns be sent by registered post, so that a record of the return is available for you.
7.9 We will not issue refunds for any items lost or stolen in transit to us.
7.10 Where a return is lost or stolen in transit to us, you should claim compensation from the company that shipped the return.
7.11 If you fail to return a product, we may make arrangements to have the product collected from you. The cost of this collection will be passed on to you.
7.12 Unused products may be returned promptly by customers directly to our suppliers, details will be given to you by our Customer Service Dept.
7.13 Subject to the above, we will refund the purchase price of a returned product within thirty days of receiving written notification of your intention to return the product.
7.14 We will also refund the cost of standard or recorded postage incurred returning a product, if incorrectly sent by us or where the product has been returned due to a defect. Please note that we will not refund any courier, overnight or express element of any delivery or postage charge, including Royal Mail Special Delivery.
7.15 We ask that you do not book any bathroom installers until you’ve received the items, checked them and are completely satisfied. We cannot accept responsibility for any loss resulting from a pre-booked installer.
7.16 The nature of the products sold by Hungerford Bathrooms (bathroom and kitchen taps, showers etc) are subject to various water pressure recommendations (amongst other recommendations) by the manufacturers.
Where possible, these are stated on our website. It is your responsibility to ensure that the products you have ordered are suitable. We strongly recommend that you seek professional advice before installation, as we will not take back products after they have been installed. - Customer Complaints
We endeavour to respond to all customer complaints or queries within five working days.
9.Warranties & liability
9.1 We do not accept liability for products that do not fit, from bathroom designs provided by us, based on measurements given by you. It is the responsibility of you and/or your installer to check that the goods provided will fit and be suitable for use within the space available. If you need to replace items which do not fit, and they have not been installed, please refer to our returns policy in section 7.
9.2 We warrant to you that all goods will be of satisfactory quality and fit for their normally intended domestic purpose. All products carry a minimum 12 month warranty. Any guarantees that exceed 12 months are provided by the manufacturer, and not by Hungerford bathrooms, and any problems that occur outside of this 12 month period should be taken up directly with the manufacturer. We will, at our discretion, help you get in touch with the manufacturer by acting on your behalf, or passing on details.
9.3 Our liability for losses you suffer as a result of us breaching this agreement is limited to the purchase price of the Product and any losses which are a foreseeable consequence of us breaching the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us. This does not limit in any way our liability for death or personal injury. We are not responsible for the following losses where they are suffered by you in relation to a business:
a.) Indirect or consequential loss, including but not limited to any loss resulting from the cost of plumbers, contractors, or anyone else involved in the installation of the products.
b.) loss of business, revenue, profits, contracts, anticipated savings, data, management or office time. All products should be installed by a qualified professional. We do not recommend attempting the installation of bathroom and kitchen items without holding the current, relevant qualifications due to the inherent technical nature of the products. It should be noted that installation by an unqualified individual may invalidate manufacturer warranties, so it is imperative that you check the terms and conditions of the manufacturer before proceeding with ‘DIY’ installation. Neither Hungerford Bathrooms nor the manufacturer can be held responsible for any costs incurred as a result of installation by unqualified individuals.
- Events outside our control
We shall not be liable for delay or failure to perform any obligation under these Terms & Conditions if the delay or failure is caused by any circumstances beyond our reasonable control, including, but not limited to, acts of god, war, civil disorder or industrial dispute. - Licence
11.1 We grant you a licence to access the content, information and services contained within our website for personal use only.
11.2 This licence allows you to download and cache (using your browser) individual pages from our website.
11.3 This licence does not allow you to download and modify individual pages or substantial parts of our website
nor to make our website available via an intranet, where our website or a substantial part of it is hosted locally on the intranet in question.
11.4 Our website design, layout, content or text cannot be copied, edited or otherwise manipulated without our express prior written permission.
11.5 Our website cannot be placed within the frameset of another site.
11.6 Third parties are not allowed to “deep link” to pages within our website, without our express prior written permission. All links (unless expressly permitted by us) should be to the main index page of our website. Furthermore, the content of such links, whether graphic or text should not be misleading, false, derogatory or in any other way offensive.
11.7 The restriction on “deep linking” does not apply to affiliate partners who wish to send customers directly to a particular page or product in order to increase their affiliate sales. - Copyright
12.1 All content, databases, graphics, buttons, icons, logos, layouts and look & feel are the copyright of My Bathrooms Design Ltd t/a Hungerford Bathrooms, unless expressly acknowledged as otherwise.
12.2 The data mining, extraction or utilisation of product information from our website is not permitted without our express prior written permission. - Reasonably Foreseeable Losses
13.1 We will be liable for any losses incurred by you due to breaches of these Terms & Conditions by us, where such losses were reasonably foreseeable at the time the contract between you and us was made.
13.2 All business, indirect or consequential losses not reasonably foreseeable at the time of the contract between you and us are excluded.
13.3 My Bathrooms Design Ltd t/a Hungerford Bathrooms does not exclude or limit liability for death or personal injury caused by the negligence or breach of duty by us, our employees or officers. - Severability
The foregoing paragraphs, sub-paragraphs and clauses of these Terms & Conditions shall be read and construed independently of each other. Should any part of this agreement or its paragraphs, sub-paragraphs or clauses be found invalid it shall not affect the remaining paragraphs, sub-paragraphs and clauses. - Waiver
Failure by My Bathrooms Design Ltd t/a Hungerford Bathrooms to enforce any accrued rights under these Terms & Conditions is not to be taken as or deemed to be a waiver of those rights unless we acknowledge the waiver in writing. - Entire Terms & Conditions
These Terms & Conditions set out the entire agreement and understanding between you and My Bathrooms Design Ltd t/a Hungerford Bathrooms. We reserve the right to change these Terms & Conditions at any time, without giving notice to you. - How the Contract is Formed Between You and Us
17.1 After placing an order with us you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us. The contract between us (Contract) will only be formed when we dispatch your items.
17.2 The Contract will relate only to those Products we dispatch to you. We will not be obliged to supply any other Products which may have been part of your order until those Products become available to us for dispatch. - Jurisdiction
These Terms & Conditions shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.
Your statutory rights are unaffected.
